These terms apply to your use of the Botanica Accounting website and its calculators. By using the website or any calculator, you agree to these terms. If you do not agree, please do not use them.

1. General information only

Everything on this website, including the calculators and their results, is general information. It does not take into account your objectives, financial situation or needs. It is not tax, accounting, legal, credit or financial advice, and it is not a substitute for advice that considers your circumstances. You should get that advice before making any decision.

Using this website, sending us an enquiry or using a calculator does not create a client relationship. We only act for you once we have agreed an engagement with you in writing.

2. Calculators

• Each calculator produces an estimate. The result depends entirely on the figures you enter and the assumptions stated on that calculator's page, including the rates and thresholds in force on the date shown.
• Results are not a tax assessment, a quote, an offer or a guarantee of any outcome. The Australian Taxation Office, state revenue offices and other authorities decide your actual liability.
• Do not use a calculator result to lodge a tax return, BAS or any other statement, to complete a loan or finance application, or as the basis for any financial, investment, property, superannuation or business decision.
• Tax laws, rates and thresholds change, sometimes with effect from an earlier date. A calculator may not reflect a change made after the date shown on its page.
• Where a calculator projects an amount two or more years ahead, it also shows that amount in today's dollars, using the inflation rate stated on the page. Projections are illustrations only and are not a prediction of what will happen.
• You can print or save any result. We may change, suspend or remove any calculator at any time without notice.

3. Not financial product advice or credit assistance

Botanica Accounting Pty Ltd is a registered tax agent. It does not hold an Australian financial services licence and is not licensed to provide financial product advice. Some calculators show the tax effect of decisions about superannuation or other financial products. Taxation is only one of the matters you need to consider when making a decision about a financial product, and you should consider taking advice from the holder of an Australian financial services licence before making such a decision. Our calculators do not recommend, advertise or promote any financial product, superannuation fund or provider, and must not be relied on to decide on a particular product.

Botanica Accounting does not hold an Australian credit licence and does not provide credit assistance. Where you ask about home loans, commercial lending or asset finance, we can refer you to a licensed lender or broker, who assesses your needs and provides any credit assistance under their own licence. If we receive a referral fee or other benefit, we will tell you before you proceed.

4. Your responsibility

You are responsible for the accuracy of the information you enter, for checking any result against your own records and current law, and for any decision you make. You use the website and calculators at your own risk.

5. Accuracy

We take reasonable care to keep the website and calculators accurate and to review rates and thresholds regularly. However, we do not warrant that any content or calculator is accurate, complete, current, free of errors or suitable for your purposes, or that the website will be available without interruption.

6. Limitation of liability

To the maximum extent permitted by law, Botanica Accounting Pty Ltd and its directors, employees and contractors exclude all liability, whether in contract, tort (including negligence), statute or otherwise, for any loss, damage, cost or expense of any kind arising from or connected with your use of, or reliance on, this website or any calculator or its results. This includes any tax shortfall, penalty, interest, lost opportunity, loss of profit, or indirect or consequential loss.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for a breach of such a guarantee can lawfully be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

Links to other websites are provided for convenience only. We do not endorse and are not responsible for their content, accuracy or availability.

8. Intellectual property

The content, design and calculators on this website are owned by or licensed to Botanica Accounting Pty Ltd and are protected by copyright. You may view, print and save results for your own personal use. You must not copy, reproduce, republish, frame, scrape or commercially use any part of the website or its calculators without our written permission.

9. Privacy

The calculators run entirely in your web browser. Nothing you enter into a calculator is stored, recorded or sent to us or anyone else. Personal information you send us, for example through the enquiry form, is handled under our privacy policy.

10. Changes and governing law

We may update these terms at any time by publishing a new version on this website. The version in force when you use the website applies. These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
